ACL ADVANTAGE AGREEMENT

This Agreement is made between Precision Athletix (“Provider”) and Client for participation in the ACL Advantage Program, a cash-pay service specializing in physical rehabilitation and return to play following ACL injury and/or surgery.

1. Services Provided

Provider agrees to deliver services designed to support the Client’s physical rehabilitation, performance, and safe return to play. The Provider is a Licensed Physical Therapist Assistant (PTA) and Certified Strength and Conditioning Specialist (CSCS) with over a decade of experience specializing in sports rehabilitation, ACL recovery, and sports performance.

 

Provider does NOT claim to be a licensed Physical Therapist. Services provided under this Agreement are not traditional physical therapy. If at any time the Client wishes to pursue traditional physical therapy, the Provider will gladly provide recommendations to trusted physical therapy clinics and professionals.

Provider will make recommendations regarding the number of weekly sessions based on the Client’s tolerance, progress, and phase of recovery. Field sessions may be added when appropriate. Client acknowledges that the Provider does not guarantee a specific number of sessions or outcomes.

2. Payment Terms and Conditions

  • Client agrees to allow Precision Athletix to save their payment method for billing per the plan selected.

  • Client acknowledges responsibility for payment of the full term of the selected training option. All payments remain due in full, even if Client discontinues training prior to the completion of the term.

  • Failure to remit payment may result in forfeiture of training time, termination of this Agreement, and the use of debt collection services.

  • Client agrees to provide a minimum of 15 days’ notice regarding changes to payment method or requests to discontinue training after completion of the membership period.

  • Payments already collected are non-refundable.

  • SEMI-PRIVATE ACL Advantage:

    • Weekly Payments: $119/week for 16 weeks (minimum)

    • Payments are collected via auto-pay for the entirety of the specified minimum term. Payments are due even if the athlete is unable to attend in-person or remotely.

    • Client acknowledges responsibility for payment of the full term of the selected training option. All payments remain due in full, even if Client discontinues training prior to the completion of the term.

    • Clients are granted access to workouts via the app for the duration of the agreed term.

    • Auto-pay continues at the same rate after the service period ends unless otherwise instructed by the Client.

    • This SEMI-PRIVATE service is not reimbursable by insurance, and the Provider does not provide super bills or insurance documentation.

  • PRIVATE ACL Advantage:

    • Per Session Payments: $149/session

    • Payments will be charged to the saved payment method at the conclusion of each session.

    • Clients are granted access to workouts via the app for the duration of the agreed term.

    • This PRIVATE service is not reimbursable by insurance, and the Provider does not provide super bills or insurance documentation.

 

3. Termination by Precision Athletix

 

Precision Athletix reserves the right to terminate this Agreement and discontinue training services at any time. In such cases, all future payments cease. Payments already collected are non-refundable; however, no further payments will be required for services not yet rendered.

 

4. Scheduling Terms and Conditions

  • Successful injury rehabilitation and physical conditioning is a long-term process; Client agrees to commit to the selected period.

  • If Client arrives late, the remaining scheduled session time will be provided unless otherwise arranged with the trainer.

  • Refunds will not be issued for relocation, illness, late arrival, weather, or unforeseen scheduling conflicts.

  • Multiple training slots are available weekly, and the trainer will make reasonable efforts to accommodate last-minute changes but cannot guarantee availability or sessions.

 

5. Client Responsibilities

 

Client agrees to:

  • Disclose all relevant medical history, restrictions, or physician recommendations.

  • Follow all instructions to the best of their ability.

  • Notify the Provider of any changes in health status.

 

6. Informed Consent / Assumption of Risk

 

Client acknowledges that participation in physical rehabilitation and training involves inherent risks, including but not limited to muscle strains, ligament injuries, or other physical harm. By signing this Agreement, Client:

  1. Voluntarily assumes all risks associated with participation in the ACL Advantage Program.

  2. Releases and holds harmless Precision Athletix, its owners, employees, and agents from any and all liability, claims, demands, or causes of action arising out of or relating to any injury, illness, or damages sustained, except in cases of gross negligence or willful misconduct by the Provider.

  3. Agrees not to pursue any legal action or claim for damages against the Provider for injuries or losses incurred while participating.

 

7. Indemnification

 

Client accepts financial responsibility for any injury they may cause to themselves or others due to their negligence. Should Precision Athletix or its representatives incur attorney’s fees or costs to enforce this Agreement, Client agrees to reimburse such fees and costs. Client further agrees to indemnify and hold harmless Precision Athletix, its principals, agents, employees, and volunteers from liability for injury, death, or property damage resulting from negligent or intentional acts or omissions while participating in activities offered by Precision Athletix.

 

By signing below, Client acknowledges that they have fully read and understand this Agreement, including the assumption of risk, release of liability, and indemnification clauses, and that they are waiving certain legal rights.
